Customer Agreement and Risk Disclosure

In consideration of Dynamic Trend, Inc. ("Dynamic") licensing its product described below to the undersigned customer ("Customer"), and in consideration of GFT, Division of Global Futures & Forex, Ltd. ("GFT") arranging to make Dynamic's product available to Customer, Customer agrees as follows:

1.	The product being licensed to Customer is the Dynamic Trend Profile ("the Licensed Product"). The Licensed Product includes computer programs, manuals, brochures, updates, revisions, seminars, web demos, training lessons and other web contents and other miscellaneous documentation and instructions for the use of the Licensed Product.

2.	Dynamic hereby grants to Customer a limited, non-exclusive, non-transferable license to use the Licensed Product for Customer's personal trading only.  This license does not convey to Customer any interest in or to the Licensed Product, but only a limited right of use revocable by the terms of this Agreement.  The Licensed Product shall be utilized by Customer only in accordance with this Agreement and shall not be de-compiled, reverse engineered, incorporated into any other product or software (including any source code, object code or algorithms), modified or disclosed in any form by any media to any other person or party.

3.	Customer will prepay GFT the published charges for licensing the Licensed Product from Dynamic.  The term of the license shall be the period of time for which Customer has prepaid the license fee charged by GFT for the Licensed Product.  Any license fee paid is non-refundable.  The license shall immediately terminate if a required payment is not paid when due.

4.	The Licensed Product is licensed "As Is". Dynamic and GFT will use their best efforts to correct any program operation errors upon proper notification by the Customer to GFT. The sole obligation in the event of a defect is to provide programming and technical support as necessary to correct the defect or refund the purchase price of the Licensed Product under this Agreement. If the product is or is likely to be the subject of a copyright or patent infringement claim, Dynamic and GFT may a) obtain the right to continue using the Licensed Product or b) replace or alter the Licensed Product to make it non-infringing. If neither of these alternatives is reasonably available, Dynamic may discontinue the license for the Licensed Product on prior written notice to the Customer.

5.	The Licensed Product uses highly complex forms of analysis that are based on theories and historical analysis, and therefore, is by its nature, untested and unproven as to future performance. In the development of this product, Dynamic has taken care to create the analysis models correctly and to use valid historical data to test the models, but Dynamic cannot and does not guarantee the models or validity of the data used to create the models. Nor will Dynamic be responsible for damages or losses caused by model failures or delays in delivery to the customer. The Licensed Product does not provide specific trading recommendations. Rather, it is a framework of technical and historical analysis, which requires Customer to make a variety of critical decisions that determine how the Licensed Product will react to market conditions.

6.	The Licensed Product and the attendant literature are believed to be accurately presented. However, the literature is not guaranteed as to accuracy or completeness, and is subject to change without notice at any time. There is no guarantee that the systems, trading techniques, trading methods, indicators or any other information used or provided by the Licensed Product will result in profits, or not result in losses. It should not be assumed, nor is any representation made, that the methods presented by the Licensed Product can guarantee profits in the foreign exchange ("forex") markets, futures markets or stock markets, or options on futures or stocks, or stock indices, or mutual funds, or any other financial instruments, or that future performance of the product will in any way equal or compare to the past. GFT, Dynamic, their employees, and Tom Joseph do not provide any specific trading recommendations through the Licensed Product, and Customer may not infer that any such advice is intended. Customer is responsible for Customer's own actions, Customer must decide whether or not to use the Licensed Product in the pursuit of Customer's trading and Customer agrees to hold GFT, Dynamic, their employees, and Tom Joseph harmless for any damage or loss that may occur.

7.	Only risk capital should be used to trade forex, futures, stocks, or options on futures or stocks, or mutual funds, or any other financial instruments, whether in conjunction with the Licensed Product or otherwise. Futures, forex, stocks, or options on futures or stocks, or stock indices, or mutual funds, or any other financial instruments involve a high degree of inherent risk and the possibility for loss is great. All investments and trades carry risks, and all trading decisions are ultimately made by Customer, and Customer is solely and individually responsible for the decisions and the results of those decisions.

8.	Trading forex or other financial instruments on margin carries a high level of risk, and may not be suitable for all investors. The high degree of leverage can work against Customer as well as for Customer. Before deciding to invest in forex or other financial instruments, Customer should carefully consider Customer's investment objectives, level of experience, and risk appetite. The possibility exists that Customer could sustain a loss of some or all of Customer's initial investment and therefore Customer should not invest money that Customer cannot afford to lose. Customer should be aware of all the risks associated with trading of forex and other financial instruments, and should seek advice from an independent financial advisor if Customer has any doubts.

9.	Dynamic and GFT are not market data providers and will not be responsible for any errors in the data used in conjunction with the Licensed Product, including but not limited to incorrect or missing data. Such errors may cause the Licensed Product to provide Customer with incorrect information that could result in substantial losses. It is Customer's duty to monitor and be responsible for finding and correcting any such data errors that may occur. The Licensed Product could also provide substantially different results when using delayed data instead of real time data.  Customer will be responsible for maintaining all equipment used by Customer in connection with the Licensed Product, and for obtaining and paying for a subscription to a data feed, as the data feed is necessary in order to use the Licensed Product.

10.	The Licensed Product relies on a) the World Wide Web (internet) for access to Dynamic's and GFT's servers and b) streaming data from the Customer's data provider. Disruption of either of these services may cause the Licensed Product to provide Customer with incorrect, incomplete or intermittent information that could result in substantial losses. Dynamic and GFT will make every effort possible to prevent any disruption of their servers or connections, but nonetheless such disruptions can and do occur. GFT, Dynamic and Tom Joseph will not be responsible or held responsible for any downtime or damages or losses caused by such disruption.

11.	The Licensed Product and the contents of Dynamic's and GFT's web sites and manuals/seminars do not give advice on specific investment objectives, financial situation and/or the particular needs of any specific person who may have access. Customers using this kind of analysis for trading typically are very aggressive traders and should appreciate the great speculative risk which is inherent in such trading. The information provided through the Licensed Product or on web sites or manuals/seminars is not directed to, or to be used by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject GFT or Dynamic, or any of their officers or employees to any registration requirement within such jurisdiction or country.

12.	Officers and employees of GFT and Dynamic, as well as Tom Joseph individually, may trade and maintain positions in forex, futures, stocks, or options on futures or stocks, or stock indices, or mutual funds, or any financial instruments that may agree or differ substantially from trades entered into by Customer while using the Licensed Product.

13.	This Agreement is governed and construed in accordance with the laws of the State of Michigan. Any or all proceedings relating to the subject matter hereof shall be maintained in the courts in the County of Kent, in the State of Michigan, or the federal district courts sitting in Michigan, which courts shall have exclusive jurisdiction for such purpose. If GFT or Dynamic substantially prevails in legal proceedings brought by or against Customer, Customer shall be liable for all reasonable costs and attorney's fees. Should Customer bring any action in arbitration or reparations, the site of such hearing shall be in the State of Michigan.

14.	GFT or Dynamic may terminate this Agreement or discontinue any license for the Licensed Product at any time for any reason with a 30 day written notice to the Customer.

15.	If any provision of this Agreement is invalid under any applicable statue or rule of law, such provision shall be deemed omitted and the balance of this Agreement shall remain binding on the parties.

16.	The Customer acknowledges and agrees that neither GFT nor Dynamic, nor their officers, directors, employees and agents, nor Tom Joseph nor his respective heirs or successors, makes any representation or guarantee regarding how this Licensed Product may perform in the future; regarding Customer's ability to utilize the information and techniques described in the Licensed Product; or regarding Customer's likelihood of success in attempting to utilize same. GFT, Dynamic and Tom Joseph do not make any warranties or guarantees with respect to the Licensed Software, including without limitation, warranties of merchantability or fitness for a particular purpose.  GFT, Dynamic and Tom Joseph shall not be liable to Customer for any loss, cost, damage or other injury, whether in contract or tort arising out of or caused in whole or in part by Customer's use of or reliance on the Licensed Product or its content, in excess of the amount paid by Customer for the Licensed Product.  In no event will GFT, Dynamic or Tom Joseph be liable to Customer for any punitive, consequential, special or similar damages even if advised of the possibility of such damage.  If some jurisdictions do not allow the exclusion or limitation of liability for certain damages, in such jurisdictions, the liability of GFT, Dynamic and Tom Joseph shall be limited in accordance with this Agreement to the extent permitted by law.

17.	Use of the Licensed Product or the results obtained therefrom for any commercial or advisory purposes is strictly prohibited. Customer represents and warrants that Customer is not a broker, and will not use the Licensed Product for trading by an institution.

18.	Customer understands and acknowledges that all orders for trades placed pursuant to signals or indicators generated by the Licensed Product are for Customer's sole risk.  Customer understands and acknowledges that there is substantial risk in trading forex, securities, commodities, futures, options and other instruments with or without the Licensed Product, and that past results are not necessarily indicative of future results.  To the extent that Customer has been or will be informed of hypothetical or simulated performance results achieved by or with the Licensed Product, Customer also acknowledges the following with respect to such results:  THESE RESULTS ARE BASED ON SIMULATED OR HYPOTHETICAL PERFORMANCE RESULTS THAT HAVE CERTAIN INHERENT LIMITATIONS.  UNLIKE THE RESULTS SHOWN IN AN ACTUAL PERFORMANCE RECORD, THESE RESULTS DO NOT REPRESENT ACTUAL TRADING.  ALSO, BECAUSE THESE TRADES HAVE NOT ACTUALLY BEEN EXECUTED, THESE RESULTS MAY HAVE UNDER- OR OVER-COMPENSATED FOR THE IMPACT, IF ANY, OF CERTAIN MARKET FACTORS, SUCH AS LACK OF LIQUIDITY.  SIMULATED OR HYPOTHETICAL TRADING PROGRAMS IN GENERAL ARE ALSO SUBJECT TO THE FACT THAT THEY ARE DESIGNED WITH THE BENEFIT OF HINDSIGHT.  NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFITS OR LOSSES SIMILAR TO THESE BEING SHOWN.

19.	Customer will hold harmless and indemnify GFT and Dynamic and their officers, directors, employees and agents, from and against any and all losses, costs, damages and liabilities, including reasonable attorneys' fees, resulting directly or indirectly from the use of the Licensed Product by Customer or Customer's agents, including any claims brought against GFT or Dynamic that arise out of or relate to the use of the Licensed Product by Customer or Customer's agents.

20.	Without the prior written consent of GFT and Dynamic, Customer may not assign, sub-license, transfer, pledge, lease, rent or share Customer's rights, duties or obligations under this Agreement to or with any person or entity, in whole or in part.  This Agreement shall be binding upon and inure to the benefit of the respective parties, their legal representatives, successors and permitted assigns.

21.	Customer understands that the monthly or annual fee will be automatically charged to Customer's account each month or year, as the case may be, until such time as Customer or GFT or Dynamic terminates this Agreement.  Customer understands that termination must be in writing, and may be sent by e-mail or by fax to GFT.  Customer understands that oral termination will not be accepted and that if Customer terminates prior to the end of a period for which Customer has already paid the charges for the license, Customer will not receive a refund of such payment. GFT or Dynamic may terminate this Agreement at any time in the event of a breach of this Agreement by Customer, and no refund will be made to Customer in the event of such a termination.  If GFT or Dynamic voluntarily terminates this Agreement before it would otherwise terminate, the terminating party will refund the corresponding pro rata portion of the charges prepaid by Customer for the period after termination.
